Divorce & Separation
We handle divorce and legal separation, including asset distribution and spousal maintenance. Idaho is a community property state, which means most assets acquired during marriage are generally subject to equal division. Spousal maintenance isn’t automatic under Idaho law. Under Idaho Code § 32-705, a requesting spouse must satisfy a two-part test: demonstrating both that they lack sufficient property to provide for their reasonable needs and that they’re unable to support themselves through employment.

Child Custody & Support
Idaho courts use a best-interests-of-the-child standard when determining custody arrangements, guided by the factors in Idaho Code section 32-717. We work with clients on custody, visitation, and child support matters, as well as paternity, fathers’ rights, mothers’ rights, and grandparents’ rights.

Modifications & Enforcement
Idaho law may allow modification of custody and support orders upon showing a material change in circumstances. The applicable order, legal standard, and specific facts determine whether a modification may be appropriate. We also handle contempt, enforcement of court orders, and money judgments.

Protection Orders & Domestic Violence
We represent clients seeking civil protection orders and assist with domestic violence-related family law matters. Parental rights and guardianship cases are also part of our practice.

Alternative Dispute Resolution
For clients who want to consider an alternative to contested litigation, we offer mediation and parenting coordination services. Parenting coordination is a child-focused process typically used in high-conflict custody cases to help parents work through disagreements about parenting plan implementation. Mediation and parenting coordination serve different roles. In mediation, an impartial mediator helps participants work toward an agreement but doesn’t decide the outcome. Parenting coordination focuses on disagreements about implementing a parenting plan, with the coordinator’s role governed by the applicable appointment and procedures.
