What Property Must Be Divided During Idaho Divorces?

In Idaho, all assets acquired during marriage are considered community property and must be divided equally between divorcing parties. This includes physical assets like real estate, vehicles, and household items, as well as intangible assets such as retirement accounts, investments, and business interests.

However, assets acquired before marriage are not subject to division. This can include personal inheritances or gifts received before the marriage. Additionally, any assets specifically outlined in a prenuptial agreement as separate property will not be subject to division.

Ways to Resolve Property Division Disputes

While some couples agree on dividing their property, others may need outside guidance to reach a resolution. Idaho courtrooms aren’t the only solution, and exploring alternative methods can often save time, money, and emotional strain.

At Jones Law Partners, we frequently guide clients through the following dispute resolution processes:

  • Negotiation - Couples can negotiate directly to determine how to fairly split assets and debts. The representation of an attorney is imperative in negotiations, as they can provide objective perspectives and help clients address any legal complexities.
  • Mediation - Couples can participate in mediation, a process during which a neutral mediator facilitates communication between parties and assists them in reaching an agreement. This process allows couples to reach a resolution without going to court.
  • Court intervention - Couples can settle property division before a judge when all else fails. While courts aim for equitable solutions, this process can be time-consuming and costly.

How Jones Law Partners Can Support You with Property Division

Our firm helps clients divide property in divorce as amicably and efficiently as possible. In doing so, we lean on the extensive know-how of our founding partner, Attorney Colby L. Jones, a dispute resolution professional with extensive experience with mediation, negotiation, and other alternative approaches to settling legal conflicts

On your behalf, Attorney Jones and our supporting legal team can:

  • Provide guidance that caters to your specific goals, whether it's financial independence, preserving family relationships, or anything else.
  • Advise on fair asset division based on state laws and prior case precedents. We have an in-depth understanding of the laws and other factors, such as the ever-evolving Boise housing market, that may impact property division. This allows us to provide highly informed guidance.
  • Assist with negotiations and/or mediation to reach mutually beneficial agreements. We believe that resolving conflicts through these processes can often lead to more satisfactory outcomes--all without the need for costly and stressful court appearances.
  • Represent clients in court proceedings if necessary. In some cases, property division must be settled in court. When this happens, our legal team is prepared to fight for our clients’ rights and interests before a judge.
